Canadian Recording Artists Claim They're Getting Screwed
By Christina Ivanowich
A massive class action lawsuit has been filed with the Ontario Supreme Court that alleges that some major players in the Canadian record industry are guilty of up to $6 billion in copyright infringement. According to court documents, it has become common practice for labels to publish a song, say on a compilation album, and simply place it on a "pending list" (that is, "pending authorization and payment") which they simply haven't yet paid for. The list began in the 1980s and, with all the accused combined, now contains more than 300,000 songs. The accused (including EMI, Sony, Warner and Universal Canada) actually admit to owing unpaid royalties of over $50 million, but the lawsuit is also asking for punitive damages of $20,000 per song ("the same standards being used to go after individual file sharers"). It's getting harder and harder not to root for the collapse of the entire record industry.
